Registration processes and ORIC support
To incorporate means to form a legally recognised entity. It means to do the things required to create a corporation, make sure it meets the requirements of law you want to be incorporated under, and then apply to have your corporation formally registered.
Different registration processes for your situation
The process you need to follow will be different based on your current situation.
- Groups or individuals can apply to register a new corporation.
- An organisation under different legislation can apply to transfer their registration to the CATSI Act.
- Corporations can apply to amalgamate existing corporations to form a new corporation.
- Deregistered corporations can apply to reinstate their registration.
ORIC's role in incorporation
We are responsible for:
- assessing applications to register a corporation under the Corporations (Aboriginal and Torres Strait Islander) Act 2006 (CATSI Act)
- if approved, registering the corporation on the Register of Aboriginal and Torres Strait Islander Corporations
Once this happens the organisation becomes ‘incorporated’ and has certain responsibilities and obligations.
Pre-incorporation assistance
ORIC can assist:
- groups who want to register
- existing organisations wanting to transfer registration
- existing corporations that want to amalgamate to form a new corporation together.
They type of assistance we can provide is information about registration requirements, the process you need to follow depending on your situation, and checking your documentation such as your proposed rule book and notices for meetings. We also offer training on starting a corporation that you can combine with a workshop for your group to design a rule book.
We can also help you apply for LawHelp which is pro-bono legal assistance from some of Australia's top law firms and lawyers.
