Regulatory decisions and actions
The Registrar has a number of regulatory and enforcement powers under the CATSI Act. What powers the Registrar exercises and when, will depend on the circumstances of each case. The Registrar’s Regulatory Posture and ORIC’s regulatory compliance framework guide how and when these powers may be used while the Registrar’s policy statements support our day-to-day decisions.
To make sure corporations are run properly, the Registrar:
- regularly assesses the governance standards of corporations—examinations
- issues directives or warnings to corporations that do not follow the CATSI Act or their rule book—compliance notices
- steps in if a corporation can't solve its problems, but only if nothing else will work—special administrations.
At times the Registrar may refer corporations for prosecution.
